Privacy policy

Finsler Customs GmbH (also “we”, “us” below) runs the Motio Studio service and processes personal data concerning you or other people (so-called “third parties”). We use the word “data” here to mean the same as “personal data”: data relating to an identified or identifiable person. “Processing” means any handling of personal data, for example collecting, storing, using, adapting, disclosing and deleting it.

In this privacy policy we describe what we do with your data when you visit our website (the “website”), order a product video from us, communicate with us or otherwise deal with us.

If you send us data about other people, we assume that you are entitled to do so and that the data is accurate. Please make sure those third parties have been told about this privacy policy. That applies above all to photos you send us for the video production.

Under data protection law, Finsler Customs GmbH (UID CHE-416.189.052), Rebbergstrasse 6, CH-8240 Thayngen, is responsible for the processing described in this privacy policy, unless we say otherwise in a particular case.

This is the body that deals with requests for access to data (section 11), for instance, and that makes sure personal data is kept secure and is not used improperly.

We process various categories of data about you. The main ones are:

We process your data in order to communicate with you, in particular to answer enquiries and to handle the exercise of your rights (section 11).

We process your data in order to enter into, manage and perform contractual relationships, in particular to produce and deliver the product video you ordered and to handle the payment that goes with it.

We process data to keep our website and our services running and secure, and to develop them further.

Where it is permitted, we process data to maintain our client relationships and for our own marketing purposes. You can refuse such contact at any time.

Where we ask for your consent to particular processing, we inform you separately about the purposes involved. You can withdraw your consent at any time.

Where we do not ask for your consent, we process your personal data on the basis that the processing is necessary in order to enter into or perform a contract with you, or that we or a third party have a legitimate interest in it.

We do not make decisions with legal significance for you on a fully automated basis. Should that change, we will inform you separately and point out the rights that come with it.

To run the website and handle your order we use carefully chosen service providers who process data on our behalf. These are in particular:

Producing your video — that is, processing your photos and briefing details — takes place on servers in Europe.

Some of the other service providers named in section 7 (payment, database, hosting, email delivery) also process data outside Switzerland, in particular in the European Economic Area and in the United States. This concerns order, contact and payment data, not your image files.

If a recipient is in a country without adequate statutory data protection, we contractually oblige that recipient to comply with the applicable data protection rules (for example through the European Commission's standard contractual clauses).

We process your data for as long as our processing purposes, the statutory retention periods and our legitimate interests require, or for as long as storage is technically necessary. We delete the photos you supplied for the production once the job is finished, if you ask us to.

We take appropriate technical and organisational security measures to preserve the confidentiality, integrity and availability of your personal data and to protect it against unauthorised processing. Data is transmitted on our website in encrypted form.

We only use what is technically necessary to keep the website running and secure. Should we use tracking or advertising techniques that go further in future, we will obtain your consent where this is required and amend this privacy policy accordingly.

This privacy policy is not part of any contract with you. We can amend it at any time. The version published on this website is the one that currently applies.
